These Terms of Service govern your use of FreshLimePay Cloud, including our online stores, checkout pages, payment integrations, products, orders, digital products, subscriptions, APIs, and related commerce functionality.

By creating an account, accessing, or using FreshLimePay Cloud ("FreshLimePay", "we", "us", or "our"), you agree to these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree with these Terms, you must not use the Service.
If you use FreshLimePay on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.
FreshLimePay provides software infrastructure that enables merchants, creators, developers, businesses, and other users to create and operate online commerce experiences.
Depending on the applicable plan and available functionality, the Service may include:
Features, limits, and functionality may vary for enterprise or custom arrangements and may be changed, improved, suspended, or discontinued from time to time, subject to applicable law and any applicable contractual commitments.
FreshLimePay's standard plan is provided with no monthly subscription fee. The standard plan currently has a monthly platform fee of $0.
FreshLimePay charges a 3.9% platform transaction fee on transactions subject to the applicable FreshLimePay platform fee.
The FreshLimePay platform transaction fee is separate from fees charged by Stripe, PayPal, or another payment provider. Payment provider processing fees, currency conversion fees, chargeback fees, payout fees, taxes, or other third-party charges may also apply.
FreshLimePay does not charge a standard monthly subscription fee for the Free plan. No setup fee is charged for the standard Free plan unless expressly stated otherwise.
Current pricing and applicable transaction-fee rules are displayed on the FreshLimePay website and may be updated from time to time in accordance with these Terms and applicable law.
FreshLimePay may offer custom enterprise solutions for businesses with advanced requirements.
Enterprise or custom arrangements may include custom store limits, custom product limits, multi-merchant functionality, advanced API integrations, custom payment infrastructure, dedicated support, custom onboarding, or other services agreed between FreshLimePay and the customer.
Enterprise pricing and commercial terms are determined individually and may be documented in an order form, proposal, agreement, or other written arrangement.
Where an enterprise agreement conflicts with these Terms, the applicable enterprise agreement will control to the extent of the conflict.
FreshLimePay provides software infrastructure and integrations. Unless expressly stated otherwise for a specific service, FreshLimePay is not a bank, payment institution, electronic money institution, money transmitter, payment processor, or custodian of merchant funds.
FreshLimePay does not maintain a payment account or wallet for merchants or their customers and does not hold, safeguard, pool, or control merchant funds.
FreshLimePay connects merchants with supported payment providers so that merchants can process payments through their own payment accounts.
Payment transactions and settlement are handled by the payment provider selected and connected by the merchant.
FreshLimePay may support integrations with third-party payment providers, including Stripe and PayPal.
When you connect a payment provider, you authorize FreshLimePay to communicate with that provider as necessary to provide the requested integration functionality.
Your use of a third-party payment provider is subject to that provider's separate terms, privacy policy, acceptable use policies, fees, verification requirements, and other requirements.
FreshLimePay does not control the decisions or policies of third-party payment providers and is not responsible for payment authorization, account verification, settlement, payout timing, refunds, chargebacks, payment holds, account restrictions, disputes, or provider outages.
You are responsible for establishing and maintaining your own account with the applicable payment provider.
Your payment provider account remains subject to the provider's terms, policies, verification procedures, and applicable laws and regulations.
Except where expressly agreed otherwise in writing, FreshLimePay does not receive, hold, own, or control merchant funds. Funds are processed and maintained through the merchant's connected payment provider account.
FreshLimePay is not responsible for the availability or release of funds by a payment provider.
To use certain integrations, you may provide API keys, access tokens, client identifiers, secrets, OAuth credentials, or other authentication information.
Where FreshLimePay stores payment provider credentials, such credentials may be encrypted using AES-256 encryption and protected using reasonable technical and organizational security measures.
Credentials are used to provide the requested integration functionality and communicate with the connected payment provider.
You are responsible for ensuring that you have authority to connect the payment provider account and for maintaining the security of your provider account.
You must provide accurate, current, and complete information when creating and maintaining your account.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account.
You must promptly notify FreshLimePay if you believe that your account has been compromised or accessed without authorization.
Merchants may use FreshLimePay to create stores, publish products, create checkout experiences, and provide information to customers.
You retain ownership of content that you submit to FreshLimePay, subject to the rights necessary for us to operate the Service.
You grant FreshLimePay a non-exclusive, worldwide, limited license to host, store, reproduce, transmit, display, and process your content solely as reasonably necessary to provide, maintain, secure, and improve the Service.
You are solely responsible for your products, pricing, descriptions, claims, images, downloadable content, customer communications, and other merchant content.
Merchants may process customer information through FreshLimePay, including names, email addresses, shipping information, billing information, order information, and other information submitted during a commerce transaction.
Merchants are responsible for determining the lawful basis for processing customer information and for providing customers with appropriate privacy notices and disclosures.
Merchants must not use FreshLimePay to collect or process personal information in violation of applicable privacy or data protection laws.
Where FreshLimePay provides digital product functionality, merchants are responsible for ensuring that they have all rights necessary to sell, distribute, or license the digital products they provide.
Merchants are responsible for providing accurate product descriptions, pricing, access conditions, refund policies, licensing terms, and other legally required information to their customers.
FreshLimePay does not guarantee that digital content cannot be copied, redistributed, or accessed without authorization.
FreshLimePay may provide merchants with functionality to offer recurring subscriptions to their own customers.
Merchants are responsible for defining subscription prices, billing intervals, renewal terms, cancellation terms, refunds, customer notices, and other conditions applicable to their customers.
Subscription transactions remain subject to the capabilities, policies, and decisions of the connected payment provider.
FreshLimePay's standard platform transaction fee is currently 3.9% per applicable transaction. This fee is a platform fee charged by FreshLimePay and is separate from payment processing fees charged by Stripe, PayPal, or another payment provider.
The applicable transaction fee may be calculated based on the transaction amount or other transaction basis disclosed by FreshLimePay at the time the transaction is processed.
Payment provider fees, including processing fees, currency conversion fees, payout fees, chargeback fees, or other provider charges, are separate from FreshLimePay's platform fee.
Merchants are responsible for managing refunds, cancellations, disputes, and chargebacks relating to their products and transactions, subject to the capabilities and requirements of their payment provider.
Unless otherwise stated by FreshLimePay or required by applicable law, transaction fees already charged may not automatically be refunded when a merchant refunds a customer. Any applicable treatment of platform fees upon refunds or chargebacks will be communicated through the applicable pricing or transaction terms.
You are responsible for determining and fulfilling your tax obligations arising from your use of FreshLimePay, including applicable sales taxes, VAT, GST, income taxes, or other taxes associated with your business activities.
FreshLimePay does not provide tax, accounting, or legal advice.
You may not use FreshLimePay for unlawful, fraudulent, abusive, deceptive, or unauthorized activities.
FreshLimePay and its software, branding, designs, interfaces, documentation, technology, and related materials are owned by or licensed to FreshLimePay and are protected by applicable intellectual property laws.
Except for the limited rights expressly granted under these Terms, no rights to FreshLimePay's intellectual property are transferred to you.
FreshLimePay may integrate with or provide links to third-party services, including payment providers, hosting providers, analytics providers, communication services, and other external platforms.
Third-party services are governed by their own terms and policies. FreshLimePay does not control and is not responsible for third-party services.
We aim to keep FreshLimePay available and reliable, but we do not guarantee uninterrupted or error-free operation.
The Service may occasionally be unavailable due to maintenance, updates, infrastructure failures, security incidents, third-party outages, or circumstances beyond our reasonable control.
We may modify, improve, suspend, or discontinue features of the Service from time to time.
Where required by applicable law, users will receive appropriate notice and any applicable rights arising from material changes to a digital service will remain unaffected.
You may stop using the Service at any time.
FreshLimePay may suspend or terminate access where we reasonably believe that you have violated these Terms, applicable law, third-party provider requirements, or created a security, legal, fraud, compliance, or operational risk.
Where reasonably practicable and legally permitted, we may provide notice before taking action. Immediate suspension may be necessary where required to protect users, payment providers, systems, or third parties.
Termination or suspension of a FreshLimePay account does not terminate or modify your separate contractual relationship with your payment provider.
Following termination or cancellation, access to your account and stored content may be restricted or removed according to our retention practices and applicable law.
Certain information may be retained where reasonably necessary to comply with legal obligations, resolve disputes, prevent fraud, enforce agreements, or maintain required business records.
Where required by applicable law, consumers may have rights to obtain certain content they provided or created while using the digital service.
Nothing in these Terms is intended to exclude, restrict, or waive mandatory rights that apply to consumers under applicable law.
Where applicable, consumers may have statutory rights relating to digital services, including rights concerning conformity, availability, changes to digital services, termination, refunds, and withdrawal.
Any applicable consumer withdrawal or cancellation rights are governed by the mandatory provisions of applicable law and any separate withdrawal information provided by FreshLimePay.
To the maximum extent permitted by applicable law, FreshLimePay is provided on an "as is" and "as available" basis.
We do not guarantee that the Service will always be uninterrupted, secure, accurate, or free from errors.
FreshLimePay does not guarantee that a payment provider will approve, authorize, settle, refund, or otherwise process any particular transaction.
Nothing in this section limits mandatory statutory rights or remedies that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, FreshLimePay will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, or goodwill arising from your use of the Service.
FreshLimePay is not responsible for losses resulting from third-party payment providers, payment authorization decisions, account restrictions, chargebacks, refunds, payment failures, provider outages, provider policy changes, or delays in payment settlement.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FreshLimePay and its officers, employees, contractors, and service providers from claims, losses, liabilities, damages, and expenses arising from your unlawful use of the Service, your violation of these Terms, your products or services, or your violation of third-party rights.
FreshLimePay may change its pricing, transaction fees, enterprise pricing, or available plans from time to time.
The current standard pricing is displayed on the FreshLimePay website. Unless otherwise stated, the standard plan currently has no monthly subscription fee and a 3.9% platform transaction fee.
Changes to pricing will apply prospectively and, where required by applicable law, will be communicated with appropriate notice.
No change to pricing will retroactively alter fees that have already become due unless required or permitted by applicable law.
We may update these Terms from time to time to reflect changes to the Service, technology, business practices, or applicable legal requirements.
When appropriate, we will provide additional notice of material changes. The updated Terms will be published on this page with a revised effective date.
Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
These Terms are governed by the laws applicable to the FreshLimePay contracting entity, except to the extent mandatory consumer or other applicable laws provide otherwise.
Nothing in these Terms is intended to remove or restrict rights that cannot lawfully be excluded under applicable law.
